Terms + Conditions

Please review our Terms and Conditions very carefully. All book projects are unique and we cannot anticipate every question that may come up, or make assumptions about any customer’s experience in the print industry. By paying your invoice you are agreeing to ALL terms & conditions outlined below, without exception. If you have any questions before proceeding with your order, it is your responsibility to clarify these with our staff. Below we have highlighted the more common issues that come up with customers during our process.

  1. Quotations/Estimates ~ A quotation not accepted within 30 days is subject to change.
  2. Accuracy of Quotation ~ The accuracy of our Instant Price Calculator is based on the specifications provided by the customer. Writual Press will modify and invoice the job per the specifications of the files received, regardless of whether they match information provided on the original quotation.
  3. Invoice ~ After file upload you will be provided an invoice for review and payment. This invoice serves as our contract with you for your order. It is vital that you review all information, as by paying your invoice you are confirming that the specifications are correct. This includes, but is not limited to: shipping address, proof format (i.e. eProof, physical proof), ancillary services (i.e. design/layout hours, ISBN), size of book, binding type, paper types, and method of shipment. Please note that the shipping date on your invoice is generated based on averages established over many years in business. However, the ship date on your invoice does not constitute a guarantee, and is frequently inaccurate as there are a multitude of factors that cannot be anticipated at time of order. This includes response times by the customer, when the invoice is paid/accepted, changes or delays during proofing, customization, etc.
  4. Orders ~ Acceptance of order takes place at the time you pay for your invoice. Canceled orders after this point will not be given a 100% refund. Costs begin accruing at the moment a customer accepts their order and are the responsibility of the customer.
  5. Files/Manuscripts/Images ~ Customer’s assume responsibility for maintaining a copy of any submissions made to Writual Press. Writual Press is not responsible for accidental damage to media supplied to us. Until submissions can be evaluated by our staff, no claims or promises are made by Writual Press regarding our ability to work with materials submitted to us.
  6. Venue ~ In the event of suit regarding this contract, then venue and jurisdiction therefore shall be in either the Common Pleas or Municipal Court, as appropriate, of the county of Boulder, Colorado. The parties agree and stipulate that the essential terms of this contract are to be performed in said County.
  7. Proofing ~ Writual Press will supply a digital proof for the customer's review. The customer should examine the proof carefully, and must respond in writing with approval before Writual Press will move forward printing the project.  Customer can provide one additional version of their book. Multiple submissions, whether by email or using the online portal provided by Writual Press, will delay your order and may incur additional costs.
  8. Errors found after order is complete ~ While our team makes every effort to see and anticipate problems in production, we only move forward with printing after YOUR approval. Writual Press does not review files for spelling, grammar, layout, or any other type of flaws unless specifically requested and paid for by the customer. It is imperative that you check your proofs for errors, even if they may have been made by our team. If you are unsure or confused by the online proofing software, it is your responsibility to request and pay for a printed proof, or request assistance from our team. Writual Press will not be responsible for undetected production errors if: 
    1. Proofs are waived by the customer
    2. The work is printed with the customer’s approval
    3. Requests for changes are communicated verbally
  9. Customer's Property ~ Writual Press will maintain fire and extended coverage on property belonging to the customer while the property is Writual Press’s possession. Writual Press’s liability for such property will not exceed the amount recoverable from insurance.
  10. Delivery ~ Unless otherwise specified, the invoice price is for a single shipment, without storage, leaving from Longmont, Colorado. Charges for delivery of materials and supplies from the customer to Writual Press, or from the customer's supplier to Writual Press are not included on the invoice unless specified. Title for finished work passes to the customer upon delivery by the agreed upon carrier.
  11. Production Schedules ~ Production schedules will be established and followed by both the customer and Writual Press. There will be no liability or penalty for delays due to a state of war, riot, civil disorder, fire, strikes, accidents, action of government or civil authority, acts of God, or other cases beyond the control of Writual Press. In such cases, schedules will be extended by an amount of time equal to the delay incurred.
    1. Production time refers to working days, not including holidays or weekends.
    2. Production begins the business day following your written proof approval.
    3. Quoted production time does NOT include shipping time to you, the customer. It is the amount of time between when you approve, and when the order leaves our facility.
    4. Production timeline will be estimated upon proof approval. However, this does not imply any guarantee on the part of Writual Press of a ship date or delivery date. If you have a specific date you must receive your order by, please communicate it with our staff prior to paying for your invoice. Our team will make every effort to accommodate, though a rush production or shipping fee may apply.
    5. If a request for changes, or a new file is received after written approval has been sent, Steuben Press will accommodate if the books are not already into production, but be aware that the production time will restart based on your new approval. Additional fees may apply.
  12. Payment Terms ~ Payment or your invoice must be made in full before we begin production of your order. We accept Visa, MasterCard, Discover, and American Express. Checks, money orders or wire transfers can also be sent, but this may delay your order.
  13. Claims for defects ~ Claims for defects, damages, or shortages must be made by the customer in writing no later than 10 business days after delivery.  Writual Press can and will assist in filing necessary claims with shipping carriers, Steuben Press is NOT liable for damages that occur during shipment. If you sign for a shipment that was damaged in transit by FedEx, UPS, USPS or any other carrier, Writual Press cannot file a claim.
  14. Disclaimer of Express Warranties and Liabilities ~ Writual Press warrants that the work is as described on the invoice. The customer understands that all sketches, copy, dummies, preparatory work, and proofs shown to the customer are intended only to illustrate the general type and quality of the work. They are not intended to represent the actual work performed. Writual Press’s maximum liability, whether by negligence, contract, or otherwise will not exceed the amount invoiced for the work in dispute. Under no circumstances will Writual Press be liable for specific, individual, or consequential damages.
  15. Indemnification ~ The customer agrees to protect Writual Press from economic loss and any other harmful consequences that might arise in connection with the work. This means the customer will hold Writual Press harmless and save, indemnify, and otherwise defend Writual Press against claims, demands, actions, and proceedings on any and all grounds. This will apply regardless of responsibility for negligence.
  16. Copyrights. ~ The customer also warrants that the subject matter to be printed is not copyrighted by a third party. The customer also recognizes that because subject matter does not have to bear a copyright notice to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce. The customer further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, the customer agrees to indemnify and hold Writual Press harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright infringement involving the work produced or provided.
  17. Personal or Economic Rights. ~ The customer also warrants that the work does not contain anything that is libelous or scandalous or anything that threatens anyone's right to privacy or other personal or economic rights. The customer will, at the customer's sole expense, promptly and thoroughly defend Steuben Press in all legal actions on these grounds as long as Steuben Press promptly notifies the customer of legal action, and gives the customer reasonable time to undertake and conduct a defense. Writual Press reserves the right to use its sole discretion in refusing to print anything Writual Press deems libelous, scandalous, improper, or infringing on copyright law.
  18. Storage ~ Writual Press retains copies of production files used until the related end product has been accepted by the customer. Materials will be stored for an additional period of six months, at no additional charge to facilitate reorders, but Writual Press is not liable for any loss or damage to stored material.
  19. Taxes ~ All taxes and assessments levied by any governmental authority are the responsibility of the customer. All amounts due for taxes and assessments will be added to the customer's invoice. No tax exemption will be granted unless the customer's "Exemption Certificate" (or other official proof of exemption) is provided prior to paying the invoice. If, after the customer has paid the invoice, it is determined that more tax is due, then the customer must promptly remit the required taxes to the taxing authority or immediately reimburse Writual Press for any additional taxes paid.
